Statusfi Terms of Use

By using the Statusfi compliance dashboard, you are agreeing to the following terms of use.

These Terms of Use govern your access to and use of our software. For purposes of these terms of use, “software” includes and incorporates by reference all related tools, materials, information, and services.

The Illinois Chiropractic Society (ICS) grants use of, license, and access to this software only to those who have accepted its terms.  By accessing and using the software, you agree to be bound by these terms. If you do not agree with any part of these terms, you must not use the software.

 

  1. Membership Requirements:

1.1 Eligibility: To be granted access to Statusfi™, you must be an ICS member in good standing.  By registering and logging into Statusfi, you represent and warrant that you meet the eligibility criteria.  The ICS reserves the right to modify eligibility requirements upon notice to users.

1.2 Registration and Account Creation: To register for a Statusfi™ account, you must ensure that the ICS has on file accurate and up-to-date information, including your name, contact information, ICS membership payment and credit card or bank information, and other details as requested. You agree to keep this information current and promptly update it if any changes occur.

1.3 Verification: We reserve the right to verify the information you provided during account creation. You agree to cooperate with any verification procedures as deemed necessary by us. Failure to comply with verification requests may result in the denial of creation of or access to a Statusfi™ account.

 

  1. Duplication Prevention:

2.1 Prohibition: You are strictly prohibited from duplicating, copying, reproducing, redistributing, or reverse-engineering any part of the software, its content (including but not limited to checklists, organization, forms and templates, and help), or its underlying technology. Any unauthorized use of the software is a violation of these terms and may result in legal action.

2.2 Unauthorized Access: We employ technical and organizational measures to prevent unauthorized access to the software and its content. You agree not to attempt to circumvent these security measures or gain unauthorized access to the software or its data.

 

  1. Usage Restrictions:

3.1 Acceptable Use: You may use the software solely for legitimate and lawful purposes related to healthcare compliance, adhering to all relevant laws, regulations, and ethical standards. You agree not to use the software for any illegal, harmful, fraudulent, or unauthorized activities.

3.2 Unacceptable Use: Prohibited activities include but are not limited to:

  • The software and data are not to be used or held out as official proof of compliance. The software is intended to be a tool to assist chiropractic physician users in tracking their own compliance with regulatory mandates and best practices.  As such, users input their own information regarding completion of individual compliance items.  The software is not designed, intended, or permitted to be used as official certification of compliance for any purpose, governmental or otherwise, and such use is strictly prohibited.
  • Interfering with the software’s functionality, integrity, or security.
  • Uploading or transmitting any content that is unlawful, defamatory, obscene, or otherwise objectionable.
  • Engaging in any activity that may compromise the privacy or security of other users or the software itself.

 

  1. Data Privacy and Security:

4.1 Data Collection: We collect and store user information in accordance with our Privacy Policy, which is incorporated into these Terms of Use by reference. By using the software, you consent to the collection and processing of your data as described in the Privacy Policy, including, but not limited to our use of cookies, or small text files that are used to store small pieces of information. They are stored on your device when the website is loaded on your browser. These cookies help us make the website function properly, make it more secure, provide better user experience, and understand how the website performs and to analyze what works and where it needs improvement.

4.2 Data Protection: We implement industry-standard security measures to protect your personal information and ensure compliance with relevant data protection laws and regulations. However, you understand that no data transmission over the internet can be guaranteed as completely secure.

4.3 Third-Party Service Providers: We may engage third-party service providers to assist with data processing and storage. These providers are contractually obligated to maintain the confidentiality and security of your data.

 

  1. Intellectual Property Rights:

5.1 Ownership: All intellectual property rights related to the software, its content, trademarks, and any other materials provided by us are and will remain Illinois Chiropractic Society’s exclusive property.  By using the software, you acknowledge the Illinois Chiropractic Society’s ownership and right to assert its property rights, as well its right to damages for any unauthorized use thereof.

5.2 License: By using the software, you are granted a limited, non-exclusive, non-transferable license to access and use the software for its intended purposes, so long as you remain an ICS member in good standing. This license does not grant you any ownership rights to the software or its content.

5.3 Trademarks: The use of the terms ilchiro™ or  Statusfi™,  or the Illinois Chiropractic Society’s logo ( ™) or the Statusfi™ logo (™) is strictly prohibited without the Illinois Chiropractic Society’s express written permission, in its sole discretion.

5.4 No access to data after ICS membership ends or not in good standing:  User has no property right in, nor access to, the information user has input into the software after such time as user’s ICS membership is no longer in good standing, is terminated, dropped, or otherwise ended.

  1. Termination and Suspension:

6.1 Termination: We reserve the right to terminate your access to the software at any time and for any reason, including but not limited to violations of these Terms of Use or status of ICS membership.

6.2 Suspension: We may suspend your access to the software temporarily if there are reasonable grounds to believe that you have violated these terms, pending further investigation, or based on status of ICS membership.

 

  1. Dispute Resolution:

7.1 Mediation: In the event of any dispute or disagreement, both parties agree to attempt to resolve the matter first through good-faith negotiation, and, if necessary, mediation.

7.2 Jurisdiction: Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts in Illinois.

 

  1. Warranty and Liability:

8.1 Disclaimer of Warranties: The software is provided “as is” without any warranties or guarantees of any kind, whether express or implied. We do not warrant that the software will be error-free, uninterrupted, or free of viruses or other harmful components.

8.2 Limitation of Liability: We shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the software. You acknowledge that your use of the software is at your own risk.

 

  1. Updates and Modifications:

9.1 Software Updates: We reserve the right to update, modify, or improve the software, its content (including but not limited to checklists, organization, forms and templates, and help), and its underlying technology at our discretion.

9.2 The Illinois Chiropractic Society will make its best efforts to include known compliance requirements for chiropractic practices in Illinois.  The Illinois Chiropractic Society will continually monitor and research new requirements and will update the software as reasonably promptly as possible, including without limitation new or revised checklists, groupings, and organization, as we determine necessary. However, users acknowledge and agree that, due to the complex and evolving nature of healthcare and business compliance, the software content will continually evolve, and that we cannot and do not guarantee that every version on any given date will include all newer compliance item that may still be under research.  By using the software, users fully waive and release the Illinois Chiropractic Society from any claim for damages related to the lack of inclusion of any particular compliance requirement(s).

9.3 Modifications to Terms: We may modify these Terms of Use from time to time, and the updated version will be posted on the software. Continued use of the software after any such changes constitutes your acceptance of the modified terms.

 

  1. Compliance with Healthcare Regulations:

10.1 Responsibility: You are responsible for ensuring compliance with all applicable healthcare laws, regulations, and standards while using the software, whether or not all healthcare laws, regulations, and standards are included in the software.

10.2 Software’s Role: The software is designed to assist you in adhering to healthcare compliance standards, but ultimate responsibility for compliance rests with you. You acknowledge that the software is a tool to aid compliance and does not guarantee compliance on its own.
